As a reminder, we, AKA Virtual and its creators, own the Intellectual Properties (IPs) of our characters, including their visual designs, illustrations, logos, music, and other contents we produce.
What is “Derivative Works”?
Derivative works encompass new expressions, creativity, or works that build upon these IPs.
To ensure both you, the fans and our creators, can collaborate together, please adhere to the following guidelines when creating and sharing derivative works.
This guideline applies to all AKA Virtual and JKT48V creators and their extended intellectual properties. Please note the specific limitation with regards to music for JKT48V-related derivative works.
Using our contents in its original form or with modifications that lack creative input does not qualify as creating derivative works and hence such use is strictly prohibited and not covered by this guideline.
Content Guidelines
Please follow the content guidelines below with regards to derivative works:
- Derivative works must respect the personalities, characteristics, and backgrounds of our characters.
- Derivative works must not contain offensive, inappropriate, or harmful content to our brand. Creating and sharing derivative works with elements of hate speech, discrimination, harassment, explicit sexual content or nudity, excessive violence or gore, defamation, slander or other harmful ways is strictly prohibited.
- Derivative works must have distinguished characteristics. You may not screen-grab our characters and its content, and claim it as your own derivative work. For example, clips of our creators must have distinguished editing styles of your own. You may not simply download and reupload a part of our content.
- Derivative works of original songs are only permitted to songs owned by AKA Virtual and its creators, except for those associated with JKT48V.
- You may not imply or state that your derivative works are official or endorsed by our agency.
- Please credit AKA Virtual and the original VTuber characters appropriately when you share your derivative works, for example, “Character Name from AKA Virtual.”
- With regards to commercial and business usage:
- Please do not use our official content for business purposes. The sale of content copied as-is or with minimal modifications is strictly prohibited.
- Sales of derivative works are allowed at a fan or hobby level, such as at conventions or online in limited quantities with a note that such sales may be evaluated based on production volume, sales price, and nature of work to determine if they qualify as business activities. We reserve the right to suspend sales activities that exceed the fan or hobby level.
We retain all copyright and related rights to our content and make no guarantees regarding the use of our content or derivative works, including potential violations of third-party rights. We are not responsible for any disputes arising from the use, performance, or submission of our content or derivative works.Please comply with all applicable laws and regulations, including the terms and rules of any relevant platforms.
Violations
Violations of these guidelines may result in actions taken against you, such as blocking, banning, and restricting access to your accounts from interacting with our creators and brands. We may also take legal action against violators.
If you come across any derivative works that violate these guidelines, please report them to us at info@akavirtual.com. We will take appropriate action to protect our intellectual property and ensure compliance with these guidelines.
Changes to Guidelines
We reserve the right to modify these guidelines at any time. Any changes will be communicated through our official channels and social media. Continued creation and sharing of derivative works following the announcement of changes will be deemed acceptance of the new guidelines.
